Preparing Clients for Mediation in Personal Injury for Lawyers (PMP)

Mediation is becoming increasingly important to the practice of law, as crucial to the conduct of your case as any other step in the litigation process. Not only can mediation save time and money for your client, it's one of the best methods for lawyers to encourage settlement, as is their duty under the new BC Code of Professional Conduct. Preparation is key to a successful mediation and this course will take you through the A to Z of preparing for a personal injury mediation. You will emerge with a detailed understanding of the mediation preparation process and a checklist to help you with every case.

Learning Outcomes:

After taking this workshop, participants will be able to:

  • describe mediation, its key characteristics, and the range of mediation approaches;
  • describe the mediation process, particularly as it is practiced in the personal injury cases;
  • describe and use basic negotiation concepts that are useful in mediation;
  • prepare a personal injury case for mediation, with the aid of a checklist; and
  • prepare a personal injury client for mediation by educating the client and applying three key communication strategies.

This four hour session offers:

  • an interactive workshop providing hands-on practice;
  • a limit of 24 participants, to ensure optimum learning.
