Description:
This is the second of the List of Documents trilogy. To qualify, you must have successfully completed the List of Documents 101 course.

At the end of your studies, you will be able to:

  • appreciate the differences between records in a party’s possession, control and power;
  • differentiate between the various grounds of privilege;
  • understand the purpose of redaction in document production;
  • learn how to record and track redactions, and indicate them in a List of Documents;
  • be able to describe more abstract or unusual documents in Part 1;
  • be able to describe privileged documents in Part 3;
  • understand the principles and procedures relating to “Further and Better Particulars”;
  • prepare an Affidavit verifying a List of Documents pursuant to Rule 26;
  • recognize when it may be appropriate to excuse a party from performance under Rule 26;
  • be able to draft and respond to a motion for production of documents on a “Halliday” and “Jones” basis; and
  • be introduced to the emerging area of electronic document production.

Each full day session offers:

  • an interactive class providing hands-on practice;
  • a limit of 18 participants, to ensure optimum learning;
  • a Desk Reference Manual, including useful checklists.
