The 1986 Supreme Court of Canada decision in Derrickson v. Derricksonruled that courts cannot apply provincial or territorial family laws respecting Matrimonial Real Property on reserves.

The Indian Act does not address this issue and as a result, many of the legal protections and rights relating to Matrimonial Real Property applicable off reserves were not available to individuals living on reserves.   The Family Homes on Reserves and Matrimonial Interests or Rights Act was enacted to address this long-standing legislative gap and ensure that people living on reserves have similar protections and rights as other Canadians.

This presentation will explore the issue of MRP on reserve including:

  • the history and context of the Family Homes on Reserves and Matrimonial Interests or Rights Act (FHRMIRA)
  •  the ability for a First Nation to enact its own law to address on-reserve MRP; and
  • an overview of the provisional federal rules which apply in the absence of a First Nation MRP Law.

CPD: 1.5 hours including 0 hour in client relations, ethics and professional responsibility.
